3. Responsibility for Data
We do not make backups of your files for data protection reasons. Always keep a copy.
While we try to ensure that the service is error free, we cannot guarantee that your files will not be damaged, deleted or lost. You acknowledge that you have a copy of all files and ExportComments will not be responsible for any failure caused by files, sent to us.
4. Limitation of Liability

5. Subscription - Access to platform
In order to register on the Platform, the User must complete every field of the registration form with full and accurate information. The data for which communication to ExportComments is mandatory are identified as such when the User is registered.
The User represents and warrants that s/he will be using the Platform in the course of her/his professional activity and, as a consequence, s/he shall not be considered as a consumer under applicable law.
In case of an incomplete or erroneous declaration, the User's account may be deactivated, ipso jure, without notice and without further formality. The User acknowledges that ExportComments shall not be held liable for any of the consequences that may arise from such an erroneous or incomplete declaration.
The User declares that s/he is able to enter into contractual relationships. Any User being under legal age warranties that s/he received the approval of her/his parents or of the person exercising the parental authority.
The registration and the creation of a User account is done using the email address that the User communicated to ExportComments and the password s/he chose (for security and confidentiality reasons, it is recommended to the User to select a password composed of several types of characters and modify it on a regular basis) or through a third-party connexion module.
The personal account of each User allows her/him to update her/his personal details.
The login name and password are personal and should not be disclosed to third parties. All uses of the Platform done using the login name and password of the User shall be deemed to have been performed by said User.
In case of disclosure of the User's login name and password, the User must connect to the Platform at the following address https://exportcomments.com/forgot-password in order to regenerate a new password.
5. Copyright Policy
Don't use our services and intellectual property for any form of infringement. You are the only responsible for the data (e.g. files, URLs) which it sends to the ExportComments service. ExportComments does not monitor customer content. One is reminded that the illicit exchanges of recordings and protected works as well as the hacking harm artistic creation. One is reminded that also non the respect of the laws in force, in particular those concerning the respect of the intellectual and artistic property, can give place to continuations and judgments.

6. Governing law and jurisdiction
This website, any information contained on it, and these terms and conditions of use will be governed by, and interpreted in accordance with, EU's law. The EU's courts have exclusive jurisdiction to hear any disputes concerning matters involving this website.
7. Delivery policy
Our services can be purchased online by payment by card. The process is secure and is done through the Stripe payment processor, being similar to any payment from e-commerce sites.
The delivery of the ordered services will be activated immediately once payment is processed, the customer will be also notified on the email mentioned at the time of placing the order when payment has been processed.
8. Refund policy
If the service really doesn't satisfy you or you have encountered problems that we were unable to solve, we will be happy to do a purchase cancellation and give you a refund. Any limitations described in the rules are not created to cause you inconvenience, but only to prevent an unfair use of this guarantee.
The standard period from the moment of acceptance and confirmation of your feedback form is 7 to 15 days. This time is necessary for us to be sure that there will be no complaints about your activity after you have completed using the service.
In exceptional cases, the refund period may be extended by several days, but we will certainly notify you of this with an explanation of the reasons.

9. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
